terms

these terms are an agreement between you and ovo talent ("we," "us"), which operates dm.samanthabaio.com ("the app") on behalf of samantha baio. by creating an account or subscribing, you agree to these terms. if you don't agree, don't use the app.

you must be 18+

the app is for adults only. by using it you confirm that you are at least 18 years old and legally able to enter this agreement. we may close any account we believe belongs to a minor.

what you're paying for

a subscription gives you access to message samantha through the app and to unlock or tip on content she shares. response times vary and aren't guaranteed, though higher tiers are prioritized. unlockable content and tips are optional purchases on top of your subscription.

how messaging works

messages and content in the app are sent on samantha's behalf and reflect her personality and direction. some replies may be drafted, scheduled, or assisted by her team and by automated tools so she can keep up with everyone. messages are for entertainment and companionship and are not professional advice of any kind.

billing and renewal

subscriptions renew automatically each billing period using your payment method on file until you cancel. intro pricing, where offered, applies to your first cycle only and then renews at the standard rate shown at checkout. payments are handled by our processors (whop and stripe).

cancellation and refunds

you can cancel any time from your account. cancellation stops future charges; you keep access until the end of the period you've already paid for. except where the law requires otherwise, payments are non-refundable and there are no partial refunds for unused time, tips, or unlocked content.

conduct

keep conversations respectful. no harassment, threats, hate speech, illegal content, requests for illegal or explicit content, spam, or attempts to take contact off-platform for payment. don't impersonate anyone or try to break, scrape, or reverse-engineer the app. we may suspend or close the account of anyone who breaks these rules, with no refund.

content rights

samantha and ovo talent own the content shared in the app. your subscription gives you a personal, non-transferable license to view it inside the app only. you may not screenshot, record, copy, re-post, sell, or redistribute any content outside the app. unauthorized sharing is a breach of these terms and may infringe our intellectual property rights.

copyright (dmca)

we respect intellectual property rights. if you believe content in the app infringes your copyright, email hi@samanthabaio.com with a description of the work, where it appears, your contact information, and a statement that you have a good-faith belief the use isn't authorized. we'll respond to valid notices as required by law.

disclaimers and limits

the app is provided "as is" without warranties of any kind. to the fullest extent allowed by law, we are not liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to the app is limited to the amount you paid us in the three months before the claim arose.

disputes and governing law

please email hi@samanthabaio.com first — most issues can be resolved quickly. these terms are governed by the laws of the state of [GOVERNING_LAW STATE], without regard to conflict-of-laws rules. any dispute that can't be resolved informally will be settled by binding individual arbitration rather than in court, and you and we waive any right to a jury trial or to participate in a class action, except where prohibited by law. you may opt out of arbitration within 30 days of first accepting these terms by emailing us.

changes

we may update these terms from time to time. when we do, we'll update the "last updated" date above, and continued use of the app means you accept the updated terms.
